    Bridal Terms and Conditions

    1. The order shall be accepted entirely at our discretion and shall constitute a legally binding contract between us and you and such contract is hereafter referred to in these terms and conditions as the order.
    2. Nothing in these terms and conditions shall prejudice any condition or warranty express or implied or any legal remedy to which we may be entitled in relation to the goods/ and or the work the subject of this order.
    3. These terms and conditions shall be construed in accordance with the laws of England and shall be subject to the exclusive jurisdiction of English courts.
    4. All goods supplied by us shall be in accordance with our current price list published from time to time and further specifications or descriptions expressly listed or set out on the face of the order. This does not include any costs incurred for alterations.
    5. After the date of the order no responsibility can be accepted by House of Mooshki for any changes to the customer’s body, shape, size or height.
    6. If you are consulting with us outside of the UK or via skype you will be advised that you will need to be fitted by a local seamstress and any alterations will be payable locally to them.
    7. All alterations are chargeable. Alterations are not performed in house and are completed by an external company. All alterations charges are payable directly to the company carrying out the alterations work. We do not accept any liability for any alterations, or damage caused during alterations completed by an external company.
    8. Each measurement taken can have up to a 2cm tolerance either way.
    9. Alterations and variations to the original order will only be accepted at the discretion of House of Mooshki and will be chargeable to the customer.
    10. Silk is a natural fibre, so the weaving of the fabric may therefore contain minor variations and irregularities that are characteristic of fine silk yarn. There should in no way be construed as defective nor should House of Mooshki be held at fault.
    11. We take extreme care in the selection of fabrics and trimmings, but we cannot guarantee to supply the exact colour shade or design detail as the sample gowns. There are shade variations with each new roll fabric used and we have no control over this and cannot be held responsible.
    12. Each gown is an individual piece and will sit differently on every brides body. We cannot be held responsible if a gown sits differently on you the bride than the sample shown in photographs.
    13. House of Mooshki cannot be held responsible for inaccuracies of supplied measurements
    14. House of Mooshki cannot be held responsible for goods or fabrics provided by the customer
    15. Our gowns on average take between 12-16 weeks unless discussed in your consultation with House of Mooshki. Couriers are out of our control and we cannot specify delivery dates.
    16. If you are purchasing your dress outside of the UK, we are not responsible for any fees or taxes levied by customs.
    17. You will be deemed to have accepted the order when you sign the confirmation of order.
    18. An initial non-refundable deposit is agreed with the team in the first consultation meeting along with a quote of how much the dress will be. The remainder balance is due at time of measurements and no order will be started until funds are received. Once the dress has gone into production there is no refunds due to each dress being a couture gown. No refunds of deposit will be given on any part of the order. In the event of cancellation, payment must be made in full for all ordered items. The goods will not be released until payment in full has been received and for cheques not until they have been cleared.
    19. Payment of the order shall become due before any alterations can take place. Full payment is due at time of measurements.
    20. Under no circumstances is anyone other than the bride our customer therefore we can only accept payment for any gowns from the customer and no third party.
    21. For the avoidance of doubt we do not accept returns and we will not issue refunds on any item ordered or on any sample dress/ item sold where you change your mind.
    22. The payment of a deposit is deemed to be acceptance of these Terms and Conditions
    23. If you wish to remove your dress from the premises without all the necessary fittings having taken place, this will only be allowed if a waiver is signed as we cannot be held response for issues arising once a gown leaves us.
    24. Sale goods are “sold as seen”, exclusive of alterations and are non-refundable for either refund or exchange.
    25. Please note that once you have placed your order, under the Sale of Goods Act 1979, you have no rights if you simply change your mind.
    26. Cancellation of made to order goods cannot be accepted if production has commenced. The order will be completed, the balance must be paid and the goods collected.
    27. Any costs incurred or accrued for a debt collection will be met by the client
    28. Ownership of the goods remain the property of House of Mooshki until paid for in full.
    29. Once the customer has taken the goods into their care they are deemed to have accepted them, and House of Mooshki cannot be held responsible for any dissatisfaction with the fit or finish of the goods.
    30. Any claim against House of Mooshki is limited to the standard retail cos of the goods in question.
    31. If the rate of the Value Added Tax (VAT) increases between the date of your order and the date of delivery we will add the necessary additional amount of Value Added Tax to the price of the goods.
    32. If you are outside of the UK the quote given will be the price of the dress only.
    33. We shall not be liable for delay or failure to perform any of our obligations under this order if the delay or failure is caused by any circumstances beyond our reasonable control. For the purposes of this condition, “force majeure” shall include, but not be limited to acts of God, war, terrorism, civil disorder, industrial dispute, fire or explosion, flood.
    34. Upon the happening of a “force majeure” event we shall be entitled to a reasonable extension of time for the performance of our obligations.
    35. We cannot be held responsible for the actions or damage caused by a dry cleaning company.
    36. We do not provide additional guarantees. We shall not under any circumstances be liable for any indirect or consequential loss howsoever caused whether by negligence, breach of contract, misrepresentation or otherwise.
    37. House of Mooshki will not be held liable for any future damage to the item purchased caused by accident, misuse or mishandling by the customer.
    38. We aim to provide a high level of service. Any enquiry or complaint regarding the goods supplied by us should be made in writing to the address below and answered within 28 days.
    39. We will not accept any complaints received from family members or third parties on behalf of yourself.
    40. If family members are deemed to be abusive and threatening, they will be asked to leave the premises.
    41. Threats of a slanderous nature via any form of media will not be tolerated and legal action will be taken if necessary
